Key Consideration for Life Sciences Patent Litigation

Appellate work demands its own perspective and skillset. The record is fixed, the factual findings are largely settled, and everything turns on the quality of legal argument: how the question is framed, how the standard of review is engaged, and how the law is applied to the facts already found. We approach every appeal with that discipline: identifying the strongest legal question available on the record, and arguing with the clarity and rigour that appellate courts require.
We have represented clients in complex intellectual property and drug regulatory cases before the Federal Court of Appeal and the Supreme Court of Canada, including seminal cases on patent damages, obviousness, utility, data protection, and patent linkage (PMNOC).
We also act as intervenors including individuals, trade associations, and public interest advocacy groups in important appellate cases where the outcome has a significance beyond the parties. Intervenor work is a distinct skill. The intervenor must contribute something the parties have not already said and must speak to the court’s interest in getting the law right, not just resolving the immediate dispute. We understand intervenors’ unique perspective, and we understand how to use that standing effectively. We accept a certain number of these cases on a reduced fee basis to ensure that important voices are able to be heard by the Court.
